Under Florida law, a THC vape cartridge is not treated the same as a small bag of marijuana. Because it is a concentrate or extract (a “resin”), it is treated as a controlled substance under § 893.13(6)(a). If a minor is caught with one, even for the first time, they face the same classification for the offense: a third-degree felony. This means serious legal consequences such as up to 5 years in state prison and a large fine — and juvenile court proceedings will apply.
